Statistics Canada owns the copyright in the Software contained within this package and all other copies that you are authorised by this Agreement to make. (“The Software”)
This licence is personal to you as the user of the Software and the licence granted herein is for your benefit only.
As user of the authorised copy of the Software, you may, subject to the following conditions:
Any commercial use of the software is prohibited. Any agreement to the contrary is void and this licence is automatically void.
Statistics Canada shall at all time retain ownership of the Software.
Statistics Canada does not warrant that this Software will meet your requirements or that its operation will be uninterrupted or error free. Statistics Canada excludes and hereby expressly disclaims all express and implied warranties or conditions not stated herein.
You acknowledge that the Software in general cannot be and is not error free and agree that the existence of such errors shall not constitute a breach of the Agreement.
This software is provided "as-is", and Statistics Canada makes no warranty, either express or implied, including but not limited to, warranties of merchantability and fitness for any particular purpose. In no event will Statistics Canada be liable for any indirect, special, consequential or other similar damages. This agreement will terminate automatically without notice to you if you fail to comply with any term of this agreement.
The Agreement and the licence hereby granted to use the Software automatically terminates if you:
In the event of termination in accordance with this clause, you must destroy or delete all copies of the Software from all storage media in your possession.
In the event that any part of this Agreement is declared by a court to be void, voidable, illegal or otherwise unenforceable, that part may be severed from this Agreement and the remaining provisions of this Agreement shall remain in full force and effect.
This Agreement constitutes the entire Agreement between the parties with respect to the licence and supersedes all previous negotiations, communications and other Agreement, whether oral or written.
This Agreement shall not be assigned in whole or in part by you, and any assignment made without the consent of Statistics Canada is void and of no effect.
This Agreement shall be governed by and construed in accordance with the laws in force in the Province of Ontario, Canada.
